Terms of Service

1. Acceptance of Terms
By accessing or using Own Your Tools ("the Service"), operated at ownyourtools.work, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time. Material changes will be communicated via email to your registered address or via an in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date of any update constitutes acceptance of the revised terms.
2. Description of Service
Own Your Tools is a web-based business management platform designed for contractors and tradespeople. The Service includes tools for client management, job scheduling, invoicing, expense tracking, mileage logging, proposal building, team communication, route planning, and other business operations features.
The Service is provided as a progressive web application (PWA) with offline-first capabilities and cloud synchronization via Supabase™.
3. Payment and Pricing
Own Your Tools is offered as a one-time purchase of $250 USD for lifetime access. This means:
- Single payment — there are no recurring subscription fees, monthly charges, or hidden costs
- Lifetime access — your purchase grants access to the Service and all future updates for as long as the Service is operational. "Lifetime" means the operational lifetime of the Service. If we discontinue the Service entirely (see Section 11), no refunds will be issued for the unused period, but we will provide reasonable advance notice so you can export your data.
- No refunds — all purchases are final and non-refundable. Because the Service provides immediate digital access upon payment, we do not offer refunds, exchanges, or credits. By completing your purchase, you acknowledge that you have reviewed the feature set at ownyourtools.work and agree to this no-refund policy.
Payments are processed securely through Stripe®. Own Your Tools does not store your credit card information.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate information — use a valid email address and keep your account details current
- Protect your credentials — do not share your login details with unauthorized individuals
- Notify us promptly — contact us immediately if you suspect unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used for fraudulent or abusive purposes.
5. User Data and Content
You retain full ownership of all data and content you enter into the Service, including client records, job details, invoices, proposals, expenses, and any other business information. You are solely responsible for:
- Data accuracy — ensuring the information you enter is correct and up to date
- Data backups — maintaining your own copies of critical business data. While we take reasonable measures to protect your data, we are not a backup service
- Compliance — ensuring your use of the Service complies with all applicable local, state, and federal laws and regulations relevant to your business, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any state-level consumer protection laws that apply to your communications with your own customers
We do not claim ownership of your data. We access your data only to operate the Service, provide support, and as described in our Privacy Policy.
6. Acceptable Use
You agree not to use the Service to:
- Violate any laws — use the platform for illegal activities or to store unlawful content
- Harm the Service — attempt to disrupt, overload, or interfere with the operation of the Service or its infrastructure
- Gain unauthorized access — access other users' data or attempt to bypass security measures
- Redistribute the Service — resell, sublicense, or redistribute access to the platform
- Send unsolicited communications — use the Service to send SMS messages or emails to recipients who have not provided prior consent to receive such messages, in violation of TCPA, CAN-SPAM, or similar laws. You are solely responsible for obtaining and documenting consent from any recipient you message through the Service.
7. SMS and Email Communications
By providing your phone number to Own Your Tools, you consent to receive transactional SMS messages from us related to your account, including trial activation confirmations and service notifications. You can opt out at any time by replying STOP to any SMS we send. Standard message and data rates may apply.
If you use the Service to send SMS or email communications to your customers, you represent and warrant that you have obtained prior express consent from those recipients to receive such communications, and that you will honor any opt-out requests they make. You agree to indemnify and hold Own Your Tools harmless from any claims, fines, or damages arising from your communications to your customers, including but not limited to TCPA violations.
8. Service Availability
We strive to keep Own Your Tools available and reliable, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We will make reasonable efforts to minimize downtime and notify users of planned maintenance when possible.
The offline-first architecture of the Service allows many features to function without an active internet connection. However, features requiring cloud synchronization, payment processing, SMS delivery, or third-party API access (Google® Calendar, Google Maps) require connectivity and are subject to the availability of those external services.
9. Limitation of Liability
To the fullest extent permitted by law, Own Your Tools and its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost revenue or profits — business losses arising from the use or inability to use the Service
- Data loss — loss or corruption of data stored in or transmitted through the Service
- Third-party actions — damages caused by third-party services integrated with the platform (Stripe®, Google®, Twilio®, Resend, Supabase™)
- Service interruptions — losses resulting from downtime, outages, or maintenance
- Communications you send — damages, fines, or liability arising from SMS or email messages you send to your customers using the Service, including but not limited to TCPA, CAN-SPAM, or similar regulatory penalties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Our total liability for any claim related to the Service shall not exceed the amount you paid for access ($250 USD).
10. Third-Party Services
Own Your Tools integrates with third-party services including Stripe® (payments), Google® (Calendar, Maps, Geocoding), Twilio® (SMS), Resend (email), and Supabase™ (database and authentication). These integrations are provided for your convenience and are governed by the respective third party's own terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the Service. In the event we discontinue the Service entirely, we will make reasonable efforts to provide at least 30 days' advance notice and allow you to export your data.
12. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or the Service shall be resolved in the state or federal courts located in Whitman County, Washington, and you consent to the personal jurisdiction of those courts.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will continue in full force and effect.
14. Entire Agreement
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and Own Your Tools regarding the use of the Service and supersede any prior agreements or understandings, whether written or oral.
